By accessing or using chpod.com, creating an account, placing an order, bidding in an auction, or posting a comment, you agree to be bound by these Terms and by our practices described here. If you do not agree with any part of these Terms, please do not use the site. We may update these Terms from time to time, and continued use of the site after changes take effect means you accept the revised Terms.

Some features — including placing orders, bidding in auctions, and posting comments — require an account. When you register, you agree to provide accurate and current information and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you believe your account has been accessed without your permission, notify us promptly at info@chpod.com. You must be at least 18 years old to create an account and make purchases.

We work to display our products, prices, and availability accurately, but errors can occur. We reserve the right to correct any errors and to change prices, promotions, and product availability at any time without notice.

• Buy One, Get One 40% Off: Our store-wide BOGO promotion applies 40% off the lower-priced item on qualifying pairs. Promotional pricing is applied automatically at checkout and may change or end at any time.
• Free shipping on orders $100 and over: Orders with a qualifying merchandise subtotal of $100 or more ship free within the United States. Order totals are calculated before tax.
• Sales tax: Applicable Florida sales tax is calculated and applied at checkout through Stripe Tax based on your order and shipping destination.

All payments are processed securely through Stripe. We do not store your full payment card details on our servers. Placing an order constitutes an offer to purchase; your order is confirmed once payment is successfully captured and you receive an order confirmation. We reserve the right to refuse or cancel any order — for example, in cases of suspected fraud, pricing errors, or items that become unavailable — and to issue a refund where appropriate.

All sales are finalexcept where an item arrives defective or damaged, as described in Refunds & Returns below.

CHPOD hosts live auctions for select items. By placing a bid, you agree to the following:

• Proxy (maximum) bidding: You may set a maximum bid, and our system will automatically bid on your behalf up to that amount in the minimum increments needed to keep you in the lead. Your maximum bid is kept private.
• Buy It Now: Where offered, Buy It Now lets you purchase an item immediately at the listed price, ending the auction for that item.
• Bids are binding: Every bid is a binding commitment to purchase the item at that price if you win. Bids cannot be retracted.
• 48-hour checkout window: If you win an auction, you must complete checkout and payment within 48 hours of the auction ending. Failure to check out within this window may result in forfeiture of the item, and we may offer it to the next highest bidder or relist it, at our discretion.

Because our merchandise is made-to-order and our auction items are one-of-a-kind, all sales are final. However, if your item arrives defective or damaged, you are eligible for a replacement or refund. Contact us at info@chpod.com within a reasonable time after delivery, include your order number and photos of the issue, and we will make it right.

Comments posted on our auction and blog pages are the opinion of the poster and do not represent CHPOD, A Cigar Hustler's Podcast, or any associated CigarHustler companies. You are solely responsible for the content you post, and you agree not to post anything unlawful, harassing, hateful, defamatory, or infringing. CHPOD reserves the right to remove any comment, and to suspend or terminate accounts that violate these Terms, at any time and for any reason.

All content on this site — including the CHPOD name, the A Cigar Hustler's Podcast name, logos, branding, artwork, product designs, text, graphics, and images — is owned by CHPOD or its licensors and is protected by copyright, trademark, and other laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission.

The site and everything on it are provided "as is" and "as available," without warranties of any kind, whether express or implied. To the fullest extent permitted by law, CHPOD and its owners, officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising out of or related to your use of the site, your purchases, or your participation in auctions. Our total liability for any claim will not exceed the amount you paid for the product or order giving rise to the claim.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or your use of the site will be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction.
